By accessing and using SkiesLIVE ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

SkiesLIVE provides a telescope access control system that allows users to book time slots for remote telescope access. The Service includes account management, booking scheduling, notification systems, and related features.

3. User Accounts

3.1 Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized use of your account
• One account per Discord user is permitted

3.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must keep your account information up to date
• You must comply with all applicable laws and regulations

4. Booking System

4.1 Booking Rules

• Bookings are subject to availability
• You must cancel bookings within the specified cancellation deadline to receive refunds
• Bookings may be subject to weather conditions and equipment availability
• We reserve the right to cancel bookings due to technical issues or safety concerns

4.2 Refunds

• Refunds of quota and coins are provided for cancellations made within the cancellation deadline
• Full refunds are provided for weather-related cancellations
• Refunds are processed automatically upon cancellation

5. Sky Coins

Sky Coins are virtual currency used within the Service to book additional telescope time beyond your allocated quota.

5.1 Coin Properties

• Sky Coins are virtual currency with no real-world monetary value outside the Service
• Coins cannot be exchanged for cash, refunded for money, or converted to other currencies
• Coins are tied to your account and cannot be transferred to other users except through the official transfer mechanism
• Coins may be granted, earned, or revoked at our discretion
• All coin transactions are final and cannot be reversed once completed

5.2 Coin Transfers

• Coins may be transferred between users using the /transfercoins command in Discord
• All transfers are subject to verification and may be monitored for fraudulent activity
• Transfers are final and cannot be reversed once completed
• We reserve the right to suspend or reverse transfers in cases of fraud, abuse, or violation of these Terms
• You are responsible for ensuring the accuracy of transfer recipient information

5.3 Purchasing Coins

• Sky Coins may be purchased through the Service using real currency
• Coin prices and packages are subject to change at any time without prior notice
• All purchases are final - completed transactions cannot be refunded, cancelled, or reversed
• Coins are delivered immediately upon successful payment processing
• You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase coins
• Payment processing is handled by third-party payment providers, subject to their terms and conditions
• We reserve the right to refuse or cancel any coin purchase at our discretion

5.4 No Refunds Policy

• Coins can only be used within the Service for booking telescope time
• Coins cannot be sold, traded, or exchanged outside the Service
• We reserve the right to modify coin values, usage rules, or availability at any time
• Coins do not expire, but may be subject to account deletion policies
• In the event of Service termination, coins have no cash value and will not be refunded

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Share your account credentials with others
• Engage in any activity that could harm or damage the Service
• Use the Service to transmit harmful code or malware

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SkiesLIVE and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Service Availability

We strive to provide continuous availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or failures
• Weather conditions affecting telescope operations
• Force majeure events

9. Limitation of Liability

To the maximum extent permitted by law, SkiesLIVE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless SkiesLIVE, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for any reason including, but not limited to, violation of these Terms. You may also request account deletion at any time through your account settings.

12. Data Deletion

Upon account deletion, we will delete or anonymize your personal data in accordance with our Privacy Policy. Some data may be retained for legal or administrative purposes as required by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
